How the Claiming Process Works

Lead Insight T/A PCP Helpdesk is a Claims Management Company (CMC). You do not have to use a Claims Management Company or Solicitor to pursue a claim. You can claim for free, without using a claims management company, first to the third party responsible or to the Financial Ombudsman Service/Financial Services Compensation Scheme.

If you choose to use a Claims Management Company or Solicitor and your claim is successful you will be charged a success fee. The FCA is likely introducing a free to use redress scheme. Eligibility and outcomes depend on individual circumstances and proper investigation.

What Charges Apply to 'No Win No Fee'?

How a Solicitor gets paid if a 'No Win No Fee' case is successful

If your Solicitor is successful in winning the claim, you are entitled to receive 100% of the awarded compensation, then, out of that compensation amount received you can pay your Solicitors fees and costs as agreed upon, which is usually in accordance with the fee table below. However, this can differ from company to company so please make sure you check the fee structure of the firm you will be instructing. Your Solicitor has a professional duty to act in your best interest and seek the best outcome from the claim. At PCP Helpdesk our panel of Solicitor's will only take a case on and pursue a claim if it meets criteria and has more than a 50% chance of winning.

PCP Helpdesk always assign a Solicitor you can trust for the complete process and will have the expect knowledge and experience to guide you throughout. At PCP Helpdesk, Our Solicitor's work on a 'no win, no fee' basis, this means you do not pay anything unless your claim is successful. However, there are some instances where fees and/or costs may be payable, which we have detailed below (Termination Fees and Adverse Costs).

Redress Amount Your Service Charge (+VAT)
£1 - £1,499 30% up to a max of £420 +VAT
£1,500 - £9,999 28% up to a max of £2,500 +VAT
£10,000 - £24,999 25% up to a max of £5,000 +VAT
£25,000 - £49,999 20% up to a max of £7,500 +VAT
£50,000 + 15% up to a max of £10,000 +VAT

Where the claim is pursued via litigation (i.e Court Proceedings) the fee cap does not apply. In which case the law firm can charge up to 50% of the amount awarded (under a Damages Based Agreement) or an hourly rate as set out in their Conditional Fee Agreement.

Termination Fees and Adverse Costs

You have an initial 14 day 'cooling off' period from when you instruct your Solicitor. However, if you cancel your claim after this 14 day cooling off period, the Solicitor reserves the right to charge you a termination fee for their reaosnable costs incurred up to the point of termination. For further details, please see the Solicitor's terms & conditions.

If your claim is purused via litigation and ultimately loses, you will be likely be responsible for adverse costs which can include the defendants legal costs and disbursements. However, if litigation is considered as a more suitable route for your claim, your Solicitor will likely recommend taking out a specific type of insurance called After the Event Insurance and arrange this on your behalf. This would cover the risk of you paying adverse costs in the event that your claim through litigation is not successful (subject to the terms of the policy). Your Solicitor would also explore whether you already have any similar type of cover in place (e.g. linked to other insurance products or finanical products you may have).
